Whenever you are injured because of someone else’s negligence, and you file a claim to recover for your damages, it is more than likely that you will be dealing with some type of insurance company. It doesn’t matter whether you were injured in a car accident or in a slip and fall on private or public property, or whether your claim involves medical malpractice. Some kind of insurer will be handling the case for the at-fault party.

As soon as you file a personal injury claim an insurance adjuster for the insurance company will be assigned to the case and that adjuster will begin scrutinizing the details of your claim, looking for ways to not pay you the full compensation you are owed.

You have been injured and may have suffered property damage due to the other party’s negligence. That means that you probably have unexpected and burdensome medical bills and repair bills to pay. But the insurance adjuster wants to pay you as little as possible.

That means, of course, that the insurance adjuster, no matter how nice he or she may sound (or may actually be) does not have your best interests at heart. The adjuster or investigator assigned to your case may do any number of things, such as:

  1. Conducting video surveillance of you – to try to catch you “faking” your injuries.
  2. Getting your old medical records – to try to put the blame for this injury on some other incident that happened in your past.
  3. Read Your Social Media Sites and Pages- looking for anything that could diminish your injuries or credibility.
  4. Asking you “loaded” questions – to get you to admit that the accident/incident was really your fault.

Of course, this is merely a few things that insurance adjusters do in an attempt to pay as little as possible to settle your claim. They will rush you; they will press you into agreeing to a settlement; they may hide information or documents to spring on you at trial or mediation.
