Zealous Advocates Fighting for the Disabled in Louisiana: Day Law Group
Despite predictions that most Americans have more than a 1 in 4 chance of experiencing a disability that will require them to miss at least 3 months of work sometime before they retire, few Americans have any short-term or long-term disability insurance.
What can you do, then, if you are struggling with mental or physical impairments that may last 1 year or more and which keep you from working?
One possibility is applying for federal disability benefits through the United States Social Security Administration (SSA). Social Security disability benefits are monthly payments that help support people who become too disabled to work. There are two (2) different programs through which the SSA pays disability benefits. They are:
While both programs provide disability benefits, they have very different rules and eligibility standards.
Social Security Disability Insurance
To qualify for Social Security Disability Insurance (SSDI or “disability benefits”), you must meet the SSA’s definition of “disabled.” You also need to have worked long enough at a job at which you paid federal taxes (i.e., FICA taxes).
Supplemental Security Income
Supplemental Security Income (SSI),on the other hand, is a needs-based program. It serves the blind, the elderly, low-income families, and disabled children of low-income families. To qualify for this program, you must meet the SSA’s definition of “disabled” and meet an income threshold.
Help With Your Social Security Claim
The application and evaluation process for either SSDI or SSI can be complex, time-consuming, and frustrating. It’s not just a matter of filling out the forms and expecting to be granted benefits. The SSA has many strict rules, regulations, and policies that must be followed to the letter. In fact, many people with legitimate claims are initially denied disability benefits. The SSA denies 70 to 75% of all first-time claims. Approximately 82% of claims that are appealed for reconsideration are also denied. On the other hand, nationwide statistics reveal that over half (53%) of all appeals taken to hearing before an Administrative Law Judge are successful when the applicant has representation.
