The reason why you can afford to hire counsel for your personal injury case is that most attorneys handle personal injury cases on a contingency fee basis.

Attorneys generally get paid in 3 ways: they charge a flat fee, they charge by the hour, or they work on contingency.

What is involved in charging a flat fee is pretty obvious. The attorney decides on a flat fee to do all the work involved in your case. This is not done very often.

More often, attorneys charge by the hour (at rates that generally start around $200 and go up from there depending on the person’s experience, skills, and location). Hourly fees can get expensive pretty quickly.

A contingency fee agreement, on the other hand, is where an attorney agrees to do all the work in your case and further agrees that he will get paid “contingent upon” your winning (“only if you win”). In other words, if you do not win the case, your attorney will not get paid. If you do win the case, then the attorney will get paid a percentage (usually around 1/3 or 33% or so, but this varies) of the award or settlement amount. Exactly how much of a percentage the attorney will get paid varies depending on how difficult, risky, or complex your case is.

Contingency fee agreements are common in personal injury cases. They allow injured people who now have extra financial burdens caused by medical bills and property damage to afford the representation they need to get the compensation they deserve.

Litigation Costs are Separate.

Whenever you file a lawsuit there are “costs” associated with it. “Costs” are things like court filing fees, mailing costs, travel costs to take depositions, transcript costs, and copying costs, just to name a few.

When you hire counsel, your Attorney-client Contract will say what costs you need to pay for and when.
