When It’s A Good Idea To Hire An Attorney For Your Workers’ Compensation Case.

Georgia B. Day

If you have been injured at work, you may be considering filing a workers’ compensation claim. Workers’ compensation claims are meant to provide injured workers with a quick and efficient way to get compensated for their work-related injuries. So does that mean you don’t need to hire an attorney if you are making a workers’ compensation claim?

Not exactly.

Some Signs That You Should Hire An Attorney.

If your situation is a simple, straight-forward case, like perhaps a twisted ankle or a cut that required a few stitches, then you probably won’t need an attorney to assist you. On the other hand, it can’t hurt to double-check your understanding of what is a simple, uncomplicated case by attending a free consultation with a workers’ compensation attorney. For example, what happens if you didn’t speak to an attorney and you settled your case before your simple stitches turned into an infection?

In most cases, having experienced workers’ compensation counsel on your side is invaluable.

If your workers’ compensation claim is denied, you should hire an attorney.

Why?

Because an attorney can appeal the denial for you and help you to get the compensation you deserve. Many perfectly valid workers’ compensation claims get denied by the insurance companies who count on the fact that the injured worker won’t file an appeal. And unless you have an attorney, you probably won’t.

Another instance when you should hire counsel is if your injuries have left you disabled. If you have serious injuries that leave you disabled, whether partially or fully, your medical expenses and lost wages are going to be significant. Meanwhile, when you make your workers’ compensation claim, you are going to be dealing with an insurance company that does not want to pay out on any claim, much less a really expensive one. So it’s not unusual for insurance company adjusters or attorneys to try “every trick in the book” to avoid paying you what you deserve. To protect yourself, you should hire experienced workers’ compensation counsel.

You don’t always need an attorney, but there are some times when it is a good idea to hire a workers’ compensation attorney to represent you.
