4 Things You Can Do To Improve Your Chances of a Successful Recovery for Your Personal Injury Case

If you have been injured because of another person’s negligence, you don’t want to do anything that may jeopardize your ability to recover from the at-fault person for the damage you have suffered. While you may not like the idea of having to pursue legal action, the truth of the matter is that it is fundamentally unfair for an innocent victim to be forced to bear not only the physical and emotional burden of often life-altering and permanent injuries that arise out of someone else’s negligence but the financial burden as well.

When you take the steps you need to after an accident or injury, you may not guaranty a perfect outcome (i.e., settlement or award) but you will at least have done all you can to ensure that your case has every chance of being a successful one.

Here are 4 things that you can do to help improve the chances of your personal injury case:

1. Get Medical Treatment Immediately. Repeat: Immediately

The first thing you need to do, not only for your potential lawsuit but for your well-being, is to get immediate medical attention. Even if you are in a minor car accident, it is critical that you get to a doctor within 24 hours of the incident.

Why?

Well, for several reasons. Among them is the fact that, especially with minor car accidents, you may think you are fine, only to have symptoms (neck pain, back pain, etc.) show up several days later. You won’t really know the extent of your injuries unless you seek medical attention immediately.

Also, when it comes to pursuing your legal claim later, you will need to document the date and time that the accident occurred, as well as what injuries you suffered. Getting medical treatment helps to establish this.

2. Collect Evidence

Assuming that you are not so injured that you need to be taken to the hospital from the scene before you leave the scene (to seek medical attention) do your best to collect evidence of the accident or incident and what happened.

For example, if you are in a car or truck accident, be sure to report it to the police and get a copy of the police report. If you are injured, for example, in a slip and fall in a restaurant, hotel, or other public place, be sure to fill out an accident report and keep a copy for yourself.

Also, if you can, take pictures of the scene. All of this is helpful documentation of what happened, when, and how.

3. Don’t Exaggerate Your Condition or the Facts

One thing you should be mindful of when making out a police report, accident report, or discussing the incident/accident at any time during your litigation, is your credibility. When you are involved in a personal injury accident, your credibility is of the utmost importance. It is critical that at every point in the process, you be as precise as you can about the facts. You do not want to exaggerate your injuries or “guess” what happened or why.

4. Get Counsel Right Away

Finally, to give your personal injury the best chance of succeeding, you should hire experienced personal injury counsel as soon as possible.

This is because one of the first things that will happen after a car or truck accident (for example) is that the negligent party’s insurance agent will try to get you to give a written or recorded statement for them. Unless you have counsel, you may very well say things that might be twisted and used to discredit you, or you might accept an offer for far less than what you are owed.

Don’t risk it.
